Terms of Service

These terms govern your use of the Messagio platform operated by Messagio ("we", "us", "our"). By creating an account or using the service, you agree to these terms.
1. Service Description
Messagio provides an AI-powered customer conversation platform. Businesses configure an AI agent through our portal; the agent handles customer conversations over WhatsApp and web chat, captures leads, manages escalations, and tracks a product catalog.
2. Account Responsibilities
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- You must provide accurate business information during registration
- You must be authorized to act on behalf of the business you register
- You must notify us immediately of any unauthorized use of your account
3. Acceptable Use
You agree not to use the service to:
- Send unsolicited messages (spam) or bulk marketing without recipient consent
- Distribute illegal, harmful, threatening, abusive, or offensive content
- Impersonate another person or entity
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service or servers
- Violate WhatsApp's terms of service or acceptable use policies
- Use the AI agent to provide medical, legal, or financial advice
- Collect or store end customer data beyond what the platform provides
4. AI Agent Limitations
The AI agent generates responses based on the knowledge base and configuration you provide. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. You are responsible for reviewing and maintaining your agent's knowledge base to ensure response quality. We are not liable for business decisions made based on AI-generated content.
5. Plans and Usage Limits
- Your plan determines your monthly message allocation, available channels, and features
- When your message limit is reached, the AI agent pauses and customers receive an automated acknowledgment
- Usage resets at the start of each billing cycle
- We reserve the right to modify plan features and pricing with 30 days notice
6. Data Ownership
- You retain ownership of your business data, knowledge base content, and product catalog
- Conversation data between your agent and customers is accessible through the platform for the duration of your plan's retention period
- Upon account closure, your data will be deleted within 30 days
- We do not claim ownership of any content you provide to the platform
7. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. The service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.
8. Third-Party Dependencies
The service relies on third-party providers including WhatsApp (via WaSender), Google Gemini API, and Resend for email. Changes or disruptions to these services may affect functionality. We are not responsible for third-party service outages or policy changes.
9. Limitation of Liability
To the maximum extent permitted by law, Messagio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10. Termination
- You may close your account at any time by contacting us
- We may suspend or terminate your account for violation of these terms, with notice where reasonable
- Upon termination, your access to the platform ceases and your data will be deleted within 30 days
- Sections regarding liability, data ownership, and dispute resolution survive termination
11. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or portal notification at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance.
